Is Immigration Reform Inevitable?

Recently, the subject of Immigration Reform has been making headlines with increasing frequency. However, many Americans are asking why, in the aftermath of September 11, 2001, would we even consider any sort of legalization program within U.S. immigration law. The short answer is that, with regard to both homeland security and our economy, it is in the best interest of our country. In fact, it is necessary.

Most of us remember Section 245(i), which, between December 20, 2000 and April 30, 2001, allowed otherwise ineligible undocumented aliens in the United States to start the sometimes long process toward legalization. By way of letter to Congress dated May 1, 2001, President Bush expressed his intention to make 245(i) permanent. Then, during August and the beginning September 2001 Congress was in fact working on just that.

However, when our nation was attacked on September 11, the issue of Legalization was dropped, and our government properly turned its attention to legislation which addressed our national security. However, the same issues that justified this administration’s desire for immigration reform in 2001 did not evaporate. Rather, they have steadily increased in urgency. Although separate and distinct, the two go hand in hand with equal significance; homeland security and our economy.

This Administration and Congress have increased governmental investigative powers with the enactment of the Patriot Act and related legislation. They have tightened our ports of entry with increased technology such as digital fingerprinting of entrants, and vastly increased criminal and terrorist databases. Although many reasonably believe that legislation such as the Patriot Act has undermined and eroded our personal liberties, it cannot be disputed that quite a number of terrorist plots against the United States have been foiled since September 11, 2001.

However, such steps have been most effective against those attempting to enter or legalize in the United States. Those left are the 12 to 15 million individuals who are present in the United States with no avenue toward legalization. We know that they are not going to leave voluntarily as their numbers continue to increase. We also know that they are responsible for performing much of the labor that American Citizens are essentially not interested in doing.

But who are they and how do we document them? This administration is acutely concerned about such a large segment of our population and workforce, about whom very little is known. Moreover, with the soon-to-be-realized mass retirement of the Baby boom generation, virtually every study confirms that the United States is headed for a severe labor shortage. That being understood by all, even if it were logistically possible, mass removal/deportation is simply not an option for our nation.
So what options remain? Legalization.

Presently there are number of immigration reform bills in Congress, all of which address to varying degrees three basic plans; enforcement, temporary relief, and permanent relief.

No matter what the final immigration reform legislation looks like, it will surely and properly include strong enforcement measures, as our continued failure to take control of our borders will certainly continue to undermine our homeland security and render meaningless whatever legalization/documentation measures we ultimately implement. As a result, we can expect significant increases in enforcement spending and border control.

However, the issues of temporary and permanent benefits are not nearly as clear-cut as enforcement.

For example, since permanent relief, a 245(i) type of program, would document the undocumented and secure an adequate labor force while raising vast funds for the Federal Government through the payment of penalties and filing fees, why is there even talk of temporary worker programs? Politics.

A 245(i) type of legalization program would undeniably constitute “amnesty”, which, when uttered by any politician is the equivalent of political suicide. However, by implementing a temporary worker program, which, such as the working visas we have in place presently, does not lead to lawful permanent resident status, the word “amnesty” can easily and justifiably be avoided. After all, a program that ends after three or six years without affording the alien lawful permanent residence, is clearly not “amnesty”.

So why not just have a temporary worker program? Business. U.S. businesses are understandably opposed to having their skilled and trained workers required to leave the United States, and their companies, every three or six years. This is especially true in the context of our upcoming labor shortage. As a result, permanent relief must be part of the reform package. Moreover, in the event that the ultra conservative interests are able to prevent the inclusion of permanent relief provisions in this immigration reform package, before the expiration of any three or six-year temporary program, permanent relief will be enacted.

Furthermore, it appears that the foregoing has been clearly understood by this Administration and Congress since well before President Bush’s Immigration reform Statement of January 7, 2004. In that statement, the President spoke of a Temporary Worker Program that would not be an “amnesty”, but, as he continued, would not preclude aliens from seeking lawful permanent residence though other legal channels. Translation: permanent relief.

Additionally, earlier this year the REAL ID ACT was enacted. Among many other things, it made it illegal for any state to issue drivers licenses to individuals unless they can prove that they have legal status in the United States. At that time, eleven states were issuing licenses without requiring such proofs.

Initially, the President was opposed to the READ ID ACT, as it essentially creates a national identification card. And, although those in favor if it say it does not do so as each state would have its own digital database of all its licensed drivers, the fact is that each state’s database is accessible by every other state and the Federal Government, resulting in a national identification card.

However, late in the game, the President became a supporter of the REAL ID ACT. Why?

When the REAL ID ACT is fully implemented, no undocumented alien will be able to get a drivers license in any state. He or she will not be able legally drive, open bank accounts, deposit paychecks, transfer funds, travel by air, or by bus or train for interstate trips. As it is not in our national interest to either deport our workforce, or to deny our workforce the ability to function within our society, a legalization program is the only possible remedy. It is however in our national interest to deny such abilities to our criminal and terrorist undocumented population.

To be sure, in order to legalize under any program every individual will be required to undergo extensive CIA, FBI and international security checks. Those who pass such checks will be permitted to legalize as they become documented. However, those who are felons, have terrorist ties, or are otherwise ineligible to become legal, will probably not participate in the program, or, if they do, will be deported. In the end, we will have a legally documented work force of individuals who have cleared deep security, background and criminal checks, with a far smaller group of criminal and/or terrorist undocumented individuals who will be essentially unable to function in our society due to their inability to secure legal identification, travel, or to open bank accounts and the like.

Finally, any legalization program will require the applicants to pay a significant penalty (probably $2,000.00 each), in addition to the filing fees for applications that they could not otherwise file. Multiply those amounts by the number of applicants, and the amount of revenue raised will be in the trillions of dollars.

So, considering the issues of homeland security, border control, maintenance of an adequate labor force, economic prosperity, and revenues to be raised, it appears that, in the absence of another catastrophic attack against the United States, significant and comprehensive immigration reform is inevitable.

Censorship in Online Article Writing

There is lots of censorship in online article writing although you may not realize it. Often if you are to post an article, someone may find fault with it as it does not fit their political views. There are many subjects that come to mind, which are often blocked such as; Gay, Lesbian and Homosexual critique, nuclear war against an enemy or issues with religions.

What is unfortunate is that while online article websites purport fairness and ethics, they indeed practice political correctness and censorship. This could drive someone nuts, as on one hand you deal with “reporter without border” comments and articles and then on another hand you have articles kicked back because someone feels that they are not Politically Correct.

Indeed this is problematic, as someone can criticize my country and threaten to nuke it or take out an American City, but the mention of such a reciprocation or advanced policy of pre-emption cannot be considered in an article? But why not? It is interesting also that folks can run around making derogatory comments and say others are homophobic, but if one criticizes the gay and lesbian community for some of their fringe and their shenanigans that is not politically correct and cannot be written about.

Folks we have a real problem here with censorship and political correctness and it needs to stop. Those who cannot handle the realities of Earth and the realities of politics and political correctness have no business running any sort of website which can be considered as part the mainstream. Censorship kills; it kills innovation, it kills truth and it kills the potential eventuality for change and openness, which fosters truth, integrity and gets to the heart of issues so that we may re-align our society and world to fulfill the common good. Consider this in 2006.

We wonder why the reporter picked that person instead. We wonder how someone got into magazines and onto radio shows. We attribute big successes with an expensive publicist. We are not sure what a publicist does but since the guy on Entourage has one, they must be a good thing. Some of use have publicist and secretly wonder why they can’t get us on the Today Show or Good Morning America. We have written books and wonder why we are not on the Oprah book club/

Advertising is something you pay for. Most of the time you have to come up with the content or copy. You need to hire a copywriter or take some training. There is more to getting people’s attention than a goofy picture. Advertising must be effective and have a call to action. You are asking the people to do something and they must be clear on what to do. Advertising has laws on what you can show and say. FCC rules in advertising will not apply to satellite radio, which is why Howard Stern is leaving regular radio. More and more people are choosing to keep out a lot of advertising by using pod casting and personalizing their media intake. Cell phone use to watch TV and communicate with people can make Generation X unreachable. Advertising is also so overbearing that people can tune it out if it does not directly speak to them.

Writers must promote their book, even if they are published by large publishers. They must create a campaign that is book effective and within budget. Publicity and PR stretch those advertising dollars.

Nepalese climber, 75, oldest person to conquer Chomolungma

Now that Bahadur Sherchan has successfully scaled the tallest mountain in the world, he is once again ready to focus on his family. Andrew Brash returned this week from Nepal after successfully climbing to the summit of Chomolungma. This year Anthony Loeff the European alpinist is reporting the scales for Everest after reaching the summit of Kilimanjaro earlier this season.

As he planned for the climb, Sherchan told reporters he wanted to inspire fellow senior citizens. He also said many Nepalese have established records on Mt Everest, so it was only fitting that the record for the oldest climber to reach the summit should also belong to a Nepali. Hall was frostbitten and severely disoriented due to altitude sickness. Min Bahadur Sherchan returned a hero to Calgarians. With the Chinese preparing for the impending summer Olympic Games, Min Bahadur Sherchan noted that the government’s actions hardly reflected the Olympic spirit. More than 2982 people have climbed to the summit since it was first conquered in 1953 by New Zealander Edmund Hillary, who died in January, and Nepal’s Tenzing Norgay.

Therefore, the decision to actualize a long-time personal goal left Bahadur Sherchan with some internal uncertainties, he cited the political actions of China and Nepal as providing the greatest adversity he faced on his journey. They flexed their muscles this year all the in name of the Olympic spirit, but it was hardly spirited at all.”

The Chinese were flying their airplanes over Mt Everest and had Chinese officials in Kathmandu. “Chomolungma or Mount Everest this year became a political pawn,” he said with some frustration.

Indeed, he was all too aware of the potential dangers the Mount Everest could bring. Certain parts of the climb are more dangerous than others and it is important for climbers to remain focused Sherchan just 8 days away from his 77th birthday beat the age record set last year by 71-year-old Japanese teacher Katsusuke Yanagisawa.

Bahadur Sherchan and four climbing guides reached the 29,035-foot (8,850-meters) summit of the world’s highest mountain early Sunday, said Ramesh Chretri, an official with Nepal’s ministry of tourism.

Andrew Brash last attempt resulted in the rescue of Lincoln Hall, an Australian climber who was left by his team in the “death zone.”

When individuals use even part of their home for business purposes they are able to write off a percentage of those costs associated with whatever part of your house you are using for a business. Step I : Get clear on what you do want.

Do know exactly where you want to be professionally in 12 mo. from today? To achieve even more clarity, I invite you to this simple visualization.

Sit in a comfortable place where you wont be disturbed. Ask yourself the following questions: In a year from now, what kind of work do you want to be doing? How many hours a week do you want to be doing it ? Who would be your ideal clients and colleagues ? What kind of people do you want to be around?
What would be your ideal physical surroundings for work? Finally, ask your self what would be your ideal income? Pick a figure that is realistic but optimistic.

Here’s an example from one of my clients of what your visualization might look like, ” In one year from today, I see myself doing real estate, working mostly with listings, and being surrounded with people I like , people who are upbeat, responsible, committed and motivated. I have my own office, and I am looking out of a big window , looking at a garden. My income is $150,000 net.”

How close is that to what you want to create?

Step 2: Overcoming the obstacles, challenges, self limiting beliefs, and self sabotaging strategies.

In Step 1, you got clarity on your ideal professional life. In Step 2, you identify the blocks you’d need to overcome to get there. So ask yourself what is stopping you? What are your self limiting beliefs? What are your self sabotaging strategies?

In my 30 years of coaching people to become successful , the self limiting beliefs that I hear the most are:

• “I’m not good enough”

• “I don’t know enough”

• “I don’t have what it takes to succeed”

• “I can’t do marketing

• “If I market myself , I’m afraid I’ll be rejected”

Take a good look at the list and ask yourself which ones resonate with you? Here’s the good news: “These are not facts, these are beliefs and beliefs can be changed” One of the things I help my clients to do is to reprogram their self limiting belief into an Empowering beliefs. If you were to reprogram the beliefs above into Empowering beliefs what would they sound like? Anything like,

• “I am more than good enough”

• “I know all that I need to know and I can always research and find the answers”

• “I have all I need to succeed”

• “I’m learning to become a Master at marketing”

• “Since I have something of value to offer my prospective clients, most likely I’ll be accepted”

How would it feel to have those beliefs as your foundation?

Step 3: Create your script

Once you have clarified what you want and reprogrammed your self limiting beliefs, the next step is to create your script. What is the area that you need to develop the most? Is it marketing, is it time management, is it confidence building? What ever you decide, you need a script to achieve it.

Why do I recommend a script rather than a plan? A business plan is a written document outlining a series of logical steps that lead to the realization of a goal in business. A business plan follows specific guidelines and requires certain information. A script, on the other hand, comes from your imagination. You can write what you want and not have to follow guidelines set by someone else.

Einstein once said, “Imagination is more important than knowledge”. Imagination is an integral part of ourselves and our intuition. When we write a script, we feel what we are writing and those feelings create physical sensations that connect our body to our imagination. When we are free to imagine and feel what we want, not only do we become like magnets to draw it to us, but also we are guided by “inspired action”

What is the difference between “inspired action” and “frantic action”? The difference is between faith and fear. As you have probably heard, “Desperation doesn’t sell”. And yet, many of my clients have come to see me in a state of fear and panic. They have been taking action steps, frantic action , based on their fear and then they wonder why their marketing isn’t working. Fear doesn’t attract clients, it repels them.

“Inspired action” on the other hand are action steps that you feel inspired to do. What inspires you? Your vision, the reason why you’re doing what you are doing. Here’s a tip, if you really want to be successful, focus on the service you’re giving to others, not on the money. The money will follow if you are making a contribution and doing what you love.

One final thought on Faith v.s. Fear. Here’s a story that illustrates the message: a student goes to his teacher and says, “I’m having a terrible struggle between my fear and my faith. My fear is represented by a black dog and my faith is represented by a white dog. They are battling all the time and I don’t know which one is going to win.” The teacher says , “Why, the white dog, of
Course.” The student says, “How do you know?” The teacher says, “Because that’s the one you’re going to feed.”
